Philomena Mwilu whose full name is Philomena Mbete Mwilu, is a Kenyan lawyer and judge. Philomena has served as the Deputy Chief Justice and Vice President of the Supreme Court of Kenya since 28th October, 2016.

Philomena pursued a Bachelor of laws at the University of Nairobi. She was admitted as an advocate of the High Court of Kenya in 1984. She went back to the University of Nairobi to study a Master of Laws Degree and graduated in 2018.

Though Amos was not yet dumbfounded till he set his eyes on Philomena who by then was working as legal department’s head of Jubilee Insurance Company. The two met over some issues that were affecting Philomena at her company, some milions had been stolen and Philomena had sought help from the Attorney General to have the culprits brought to book.

Career

Justice Philomena has worked over 35 years in her legal career. In 1984, she began by practicing law in the firm of Muthoga Gaturu & Company. She was later transferred to Mutunga & Company Advocates. Mwilu was appointed senior legal manager at Jubilee Insurance Company Limited in June 1991, where she worked till 1997. From 1999 to 2001, Mwilu was the Board secretary at the Electricity Regulatory Board of Kenya and from 2006 to 2007, she worked as the deputy chairperson of the Energy Tribunal. She served as a director of the board of Nairobi Water and Sewerage Company in 2007. She was later served as chair of the Legal and Human Resource Committees of the board, prior to Mwilu joining the Kenya Judiciary.

In 2008, Philomena was appointed High Court judge, first serving in the Commercial Court Division in Nairobi and then moved to the High Court in Eldoret. Mwilu was transferred back to Nairobi where she served at the Criminal Division of the High Court from Eldoret. In January, 2012, Philomena was appointed the head of the Environment and Land Division of the High Court. In November, 2012, Mwilu was appointed as a Justice of the Kenya Court of Appeal. She was nominated to take the position of Deputy Chief Justice of Kenya, to replace Kalpana Rawal, who had attained the mandatory retirement age of 70, in October 2016. After interviewing her and over 14 other nominees, the Judicial Services Commission selected her to become the next Deputy Chief Justice.

Justice Mwilu was elected by fellow Judges of the Supreme Court as their representative in the Judicial Service Commission, in May 2017. She was among the Judges who heard the 2017 presidential election petition, joining CJ David Maraga as well as associate Justices Smokin Wanjala and Isaac Lenaola in nullifying President Uhuru Kenyatta’s win. When a petition was filed to stop the fresh election that was scheduled following the nullification of the August presidential election, Mwilu was among the Judges who failed to show up in court to hear the petition, forcing CJ David Maraga to adjourn the hearing. Apart from David Maraga, only one of the remaining six judges was available for the hearing and a day before the hearing, Mwilu official car had been shot at while driving through traffic, with her driver sustaining gunshot wounds.
